Article 1 (Personal Information)
When you purchase an item(s) on the Site or register to use the Site, you are required to provide your information including, but not limited to your name, postal address, phone, and email address. This information will be used only to provide the service you requested and will not be used for any other purpose, except as set forth in the Privacy Policy (link to Privacy Policy). By placing an order, you promise that ll the information you provide is correct and complete.
Article 2 (Prices, Shipping cost, Taxes)
Prices of the items sold on the site are in U.S. Dollars and will be the same prices as those at the stores located in Hawaii. Customers are required to pay the price of the items ordered, shipping costs, and taxes at the time the order is placed. Retailers are required by law to collect a sales tax for the state to which the items are shipped. The amount of state sales taxes due will automatically be calculated depending on the state to which the items are shipped and be added to your total price.
When you place your order indicating “you will pick it up at the store (in Hawaii)”, the applicable sales tax will automatically be charged on the items, however, no shipping cost will be charged.
The total price you will be charged, including item prices, shipping costs, and taxes, is displayed on the site, in the “shopping cart” before you check out.
You can also refer to the shipping cost table on the web site before shopping.
For international shipping, you are responsible for the customs fee, when it is applicable. Customs fees vary for each country and we are unable to determine what they will be. We ask that you contact your local customs bureau for more information.
Article 3 (Payment)
We accept payment by credit card only. You agree to provide credit card and account information that is true, current, and complete. You also agree that charges you incur will be honored by your credit card company, and that you will pay the charges you incur at the posted prices in the “shopping cart”. We reserve the right to cancel your order if the credit card or account information you provide to us is incomplete or inaccurate.
Article 4 (Delivery)
Unless specified otherwise on the product page, we will ship the items within 48 business hours by USPS First Class Registered Mail, First Class, or Priority Mail). We will inform you of the tracking number when we ship the items. Please note there are some possibilities that we cannot manage this shipping schedule, due to the transaction volume, or in case of emergency.
Article 5 (Damaged Items)
When shipped item(s) are damaged in delivery, we will send you the same item(s) at our cost on the condition that you inform us of the damage at originals@lealeamarket.com within 7 days after you receive the item, and then follow the instruction from the store. We might ask you to send the photos of the damaged items, so please do not discard them till the refund process is done. If the same item is out of stock and cannot be sent to you, we may, in our sole discretion, choose to refund you the price you paid for those item(s) instead, including the shipping fees applicable to the damaged items.
Article 6 (Cancellation and Refund)
If you change your mind, you may cancel your order by notifying us at originals@lealeamarket.com before we ship the item(s). If we receive your cancellation notice before the item is shipped, we will cancel your order and refund the full amount to the credit card you used for payment.
If we receive your cancellation notice after we ship the item(s), you will receive a refund only on item(s) sent back to us immediately after your receipt at your cost, without opening or usage. We will refund the amount of the returned item on the credit card used to purchase the items, upon receiving it in “new, unused” condition, but cannot refund shipping costs.
We do not accept returns for item(s) returned (1) more than 7 calendar days after you receive the item, or (2) in a different condition from when you received it, including but not limited to opened or used items.
Article 7 (Modification to Terms of Sale)
This Terms of Sales might be modified without notice. We might be unable to ship items due to inclement weather or disasters.
Article 8 (Disclaimers)
EXCEPT ASOTHERWISE EXPRESSLY PROVIDED IN THIS AGREEMENT, NEITHER PARTY MAKES ANY WARRANTY WITH RESPECT TO ANY TECHNOLOGY, GOODS, SERVICES, RIGHTS OR OTHER SUBJECT MATTER OF THIS AGREEMENT AND EACH PARTY HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, VALIDITY AND NONINFRINGEMENT.
